Legislation \u2013 a Primer and an Update"},"content":{"rendered":"<p class=\"p1\">Starting last August, NH Rail Trails Coalition and the Bike-Walk Alliance of NH worked on NH <a href=\"https:\/\/www.gencourt.state.nh.us\/bill_status\/billinfo.aspx?id=1590&amp;inflect=2\">HB-1543<\/a> to address high-speed and high-power \u201cPersonal Electric Vehicles\u201d (PEVs), also called \u201cMicro Mobility Devices.\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span>One category is the \u201celectric <em>motorcycle<\/em> with pedals\u201d being sold and used on both rail trails and public roads as if they were an actual<em> e-bike<\/em>.<span class=\"Apple-converted-space\">\u00a0 <\/span>We always have issues with \u201ctrail etiquette\u201d concerning conventional bike riders and even walkers on rail trails, but when devices capable of 40-60 MPH are being used the problems escalate drastically.<span class=\"Apple-converted-space\">\u00a0 <\/span>There is no comparison between a \u201ctrue\u201d e-bike with a maximum powered speed of 20 MPH assisted by a motor not exceeding one HP (750 watts) and the \u201celectric motorcycles\u201d with 16 HP (12,000 watt) motors, maybe greater. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-6739\" src=\"https:\/\/nhrtc.org\/nhrtc-core\/wp-content\/uploads\/2024\/03\/PEV-Micro-Mobility-devices-030624b.png\" alt=\"\" width=\"645\" height=\"365\" srcset=\"https:\/\/nhrtc.org\/nhrtc-core\/wp-content\/uploads\/2024\/03\/PEV-Micro-Mobility-devices-030624b.png 781w, https:\/\/nhrtc.org\/nhrtc-core\/wp-content\/uploads\/2024\/03\/PEV-Micro-Mobility-devices-030624b-300x170.png 300w, https:\/\/nhrtc.org\/nhrtc-core\/wp-content\/uploads\/2024\/03\/PEV-Micro-Mobility-devices-030624b-768x435.png 768w\" sizes=\"auto, (max-width: 645px) 100vw, 645px\" \/><\/p>\n<p class=\"p1\">Now we have other PEVs like fast and powerful electric skate boards, scooters, \u201cOne Wheels\u201d and electric unicycles (EUCs), all with capabilities and specs far exceeding the e-bike limits.<span class=\"Apple-converted-space\">\u00a0 <\/span>Some can navigate very well off-road on rough terrain, never mind on rail trails with a stone dust surface.<span class=\"Apple-converted-space\">\u00a0 <\/span>HB-1543 started to address these issues on the premise that these \u201cOut-of-Class Electric Vehicles\u201d (OCEVs) should be considered \u201cmotor vehicles\u201d and regulated as such. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Meanwhile, unbeknownst to us, a second PEV bill, <a href=\"https:\/\/www.gencourt.state.nh.us\/bill_status\/billinfo.aspx?id=1678&amp;inflect=2\">HB-1445<\/a>, was introduced by a lone State Representative that basically would have banned all true e-bikes on rail trails and require them to be registered.<span class=\"Apple-converted-space\">\u00a0 <\/span>NHRTC and BWANH pushed against this bill and with a lot of support from rail trail groups, \u201croadies\u201d and e-bike dealers the bill died in committee.<span class=\"Apple-converted-space\">\u00a0 <\/span><\/p>\n<p class=\"p1\">The whole situation is very complicated as we are looking at state agency involvement, education, and enforcement.\u00a0 As we acknowledge that PEVs, even the fast and powerful devices, have their place in a modern society desiring economical and non-polluting transportation options, it is a matter of where and how they are used.\u00a0 There is nothing wrong with a car capable of 140 MPH being driven at 65 MPH on an Interstate highway. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Bottom line, both HB-1445 and \u201cour\u201d HB-1543 were voted \u201cInexpedient to Legislate\u201d (ITL\u2019d = killed) by the House Transportation Committee.<span class=\"Apple-converted-space\">\u00a0 <\/span>The committee chair agreed there is a need for legislation and suggested an updated bill be filed for the next session that starts in September 2024.<\/p>\n<p class=\"p1\">Subsequent to the above legislative hearings, BWANH and NHRTC conducted an open Zoom Q&amp;A session to present details and pro \/ con positions on PEVs in general.<span class=\"Apple-converted-space\">\u00a0 <\/span>The two ITL\u2019d bills and the Q&amp;A session were picked up by PEV user groups on YouTube videos and viewed around the country.<span class=\"Apple-converted-space\">\u00a0 <\/span>That resulted in a productive hybrid Zoom meeting\u00a0 in February with leaders of many PEV user groups representing NH, ME, VT, MA, RI, NY, NV, CO and CA.<span class=\"Apple-converted-space\">\u00a0 <\/span>This was the first such meeting known to welcome \u201cPEV players\u201d from multiple states and across the country.<span class=\"Apple-converted-space\">\u00a0 <\/span>The quick take-away was that everyone felt regulations are coming, we have a \u201cWild West\u201d environment today, and if PEV users are recognized as being \u201clegitimate\u201d operators with regulations most current issues will be resolved.<\/p>\n<p class=\"p1\">The next steps toward NH legislation for 2025\u00a0are planned meetings with the national PEV user groups, local bike-ped \/ rail trail advocates, NH State Reps and Senators, our NH state agencies plus the AAA. <span class=\"Apple-converted-space\">\u00a0 <\/span>These meetings will commence in April with a draft \u201cLegislative Service Request\u201d (LSR) starting a new bill to be introduced in August.<span class=\"Apple-converted-space\">\u00a0 <\/span>By working together and understanding the PEV technology, user needs, safety concerns of all and the environment, we should be able to draft some model legislation that has support across the whole spectrum.<span class=\"Apple-converted-space\">\u00a0 <\/span>And by the way, just using these PEVs can be a lot of fun and gives the users freedom not possible in an expensive two-ton car.<\/p>\n<p class=\"p1\">Stay tuned as were move ahead with new PEV legislation.<span class=\"Apple-converted-space\">\u00a0 <\/span>These devices are here today and growing in popularity.<span
